1. ELIGIBILITY
NO PURCHASE NECESSARY. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. Contest is open only to legal residents of the United States (excluding Puerto Rico) who are 18 years or older at time of entry. Entries are limited to individuals only; commercial enterprises and business entities are not eligible. Employees or contract employees of Deckers Outdoor Corporation and its affiliates, subsidiaries, agents, and parents and their immediate families or persons living in the same household of such individuals, are ineligible. CONTEST IS VOID IN PUERTO RICO AND WHERE PROHIBITED BY LAW.

2. SPONSOR
Sponsor is: Deckers Outdoor Corporation, 495-A S. Fairview Ave, Goleta, CA 93117.

3. SCHEDULE
The first 2010 monthly Contest begins at 12:00:00am Pacific time January 1, 2010 and ends at 11:59:59pm Pacific time January 15, 2010. Thereafter, the monthly Contest begins 12:00:00am Pacific time on the first (1st) day of each month and ends at 11:59:59 Pacific time on the fifteenth (15th) day of such month. The first FOTM contest will commence on January 1, 2010, with the last FOTM contest to be run in April 2010, ending on April 15, 2010 at 11:59:59pm Pacific time.

4. HOW TO ENTER
Requirements for Entry: To enter, you must fill out the FOTM application in its entirety, including your photo submission ("FOTM Application"). Any incomplete applications will not be considered. Your FOTM Application must meet each of the following requirements in order to be accepted as a Contest entry:

• 1. The photograph must be in one of the following formats: .jpg or .gif.
• 2. The FOTM Application must not violate any third party's rights, including, but not limited to, copyrights, rights of publicity, or trademark rights. The FOTM Application must not contain any third party materials, or otherwise violates or infringes (or may infringe) any copyright, trademark, logo, mark that identifies a brand or other proprietary right of any person living or deceased (including but not limited to rights of privacy or publicity or portrayal in a false light) or entity, or is otherwise objectionable.
• 3. The photograph of you may not contain any nudity, or depict any obscene, indecent, illegal, or unsafe behavior, acts of violence or acts that appear to cause harm, as determined by the Sponsor in its sole discretion.
• 4. Entrants must have all rights to the photograph submitted.
• 5. The photograph submitted must be of the entrant (you) ONLY.
• 6. Limit of one (1) entry per person per monthly FOTM Contest.

By submitting the FOTM Application, you represent and warrant that there are no violations of the above requirements. Sponsor may review your FOTM Application to ensure compliance with the above requirements. Any FOTM Application deemed by Sponsor, in its sole discretion, to violate any of the above requirements will not be approved and will be disqualified from the FOTM Contest. The decisions of the Sponsor are final and binding.

Enter the FOTM Contest by submitting your FOTM Application at www.simpleshoes.com, following the instructions therein.

SPONSOR'S USE OF FOTM APPLICATION CONTENT
By submitting your FOTM application, you:

• 1. Irrevocably grant to the Sponsor, its agents, licensees, and assigns and its partners the unconditional and perpetual (non-exclusive) right and permission to copyright, reproduce, encode, store, copy, transmit, publish, post, broadcast, display, publicly perform, adapt, modify, create derivative works of, exhibit, and otherwise use the content of the FOTM Application as-is or as-edited (with or without using your name) in any media throughout the world for any purpose, without limitation, and without additional review, compensation, or approval from you or any other party ("Sponsor's Use").
• 2. The owner of any information or the photograph in the FOTM Application retains all rights to title and interest therein, notwithstanding the foregoing, you forever waive any rights of copyrights, trademark rights, privacy rights, and any other legal or moral rights that may preclude the Sponsor's Use of your FOTM Application, or require your or a third party's permission for the Sponsor's Use of the FOTM Application.
• 3. Agree not to instigate, support, maintain, or authorize any action, claim, or lawsuit against Sponsor's Use of the FOTM Application, or any derivative works, infringes any of your rights or another's rights as creator of the FOTM Application, including, without limitation, copyrights, trademark rights, and moral rights.

ENTRIES
All entries, including the contents of the FOTM Application, become the property of Sponsor. They will not be returned or acknowledged. Sponsor is not responsible for lost, late, misdirected, mutilated, incomplete, entries. Entries are void if they are in whole or in part, incomplete, damaged, irregular, altered, counterfeit, produced in error, or obtained through fraud or theft. By entering you agree to be bound by these Official Rules.

MONTHLY PRIZE
One (1) FOTM Contest winner will be selected per month. Each FOTM prize will consist of:
- One (1) pair of Simple® Shoes (size and style to be chosen by winner, subject to Deckers' availability) and one (1) fan gift pack, which consists of a Simple® bag, water bottle and stickers. Approximate total retail value of $120.00.
Any difference between approximate retail value and actual retail value will not be awarded. Sponsor reserves the right to substitute prize in which case a prize of equal or greater value will be awarded.
All federal, state and local taxes, fees and surcharges on Prize are the sole responsibility of the FOTM winner(s).

WINNER-SELECTION / JUDGING
All eligible FOTM Applications will be judged on or before the seventeenth (17th) day of the month during which the applications are accepted by a panel of three (3) judges based on the following criteria: a) "biggest fan"; b) creativity; and c) originality, as determined by a vote of all three judges. The FOTM Application with the top overall score will be determined the Contest winner. Judges' decisions are final with respect to all matters relating to the Contest. By participating, entrants agree to the Official Rules and the decisions of the Judges, which shall be final and binding in all respects. In the event of a tie, the winning FOTM Application shall be the FOTM Application which Simple Shoes determines is the FOTM Application that exemplifies the "biggest fan." Judges reserve the right not to award an FOTM Contest Prize if they determine that no FOTM Application qualifies. The FOTM Contest winners will be notified by e-mail or by phone on or before the twentieth (20th) of the month during with the FOTM Application is received.

REDEMPTION AND VERIFICATION
To redeem the prize, the FOTM Contest winner(s) must respond within three (3) days of prize notification. If we receive no response from the winner within three (3) days from the first contact attempt, an alternative winner will be selected. Prizes will be mailed no later than fourteen (14) days after Sponsor's receipt of winner's redemption and Simple® shoe style, color and size information, and may take up to fourteen (14) days to arrive. Odds of winning depend on the number of eligible entries received. All prize claims are subject to verification and compliance with the Official Rules.

LIMITATION ON LIABILITY
Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, or delay in operation or transmission; communications line failure; theft or destruction of or unauthorized access to contest entries or entry forms; or alteration of entries or entry forms. Sponsor is not responsible for any problems with or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any e-mail or mailed-in entry to be received on account of technical problems or traffic congestion on the Internet or at any Web site, or any combination thereof, including any injury or damage to participants' or any other persons' computers related to or resulting from participation or downloading any materials in this contest.

CAUTION: ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

FURTHER, SPONSOR AND ITS PARTNERS, AFFILIATES, SUBSIDIARIES, ADVERTISING AGENCIES, AGENTS AND THEIR EMPLOYEES, OFFICERS, DIRECTORS AND REPRESENTATIVES HAVE NO LIABILITY TO PARTICIPANT(S) FOR ANY DAMAGESTHAT MAY RESULT FROM PARTICIPATING IN THE FOTM CONTEST.

RIGHT TO CANCEL OR SUSPEND CONTEST
If for any reason the Contest is not capable of running as planned, due to tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsor that corrupt or affect the administration, security, fairness, integrity, or proper conduct of this contest, the Sponsor reserves the right, at its sole discretion, to disqualify any individual(s) who tamper with the entry process, and/or to cancel, terminate, modify, or suspend the Contest.

CONDITIONS OF PARTICIPATION
By entering the FOTM Contest, entrants agree to release, discharge and hold harmless Deckers and their partners, affiliates, subsidiaries, advertising agencies, agents and their employees, officers, directors, and representatives from any and all liability, claims, or actions of any kind whatsoever sustained in connection with participating in any aspect of the Contest, the receipt, ownership or use of prize awarded or any typographical or other error in these Official Rules or the announcement of offering of the prize. Participants also agree (a) to be bound by these Official Rules; (b) that the decisions of Sponsor are final on all matters relating to the contest; and (c) if he/she wins, to the use for advertising and promotional purposes any information submitted in the FOTM Application without compensation (except where prohibited by law) and upon request, to provide consent to such use in writing.

For FOTM Contest winner names after May 1, 2010, send a separate self-addressed, stamped envelope to Deckers Outdoor Corporation c/o Simple® Shoes at Mailing Address: 495-A S. Fairview Ave, Goleta, CA 93117 (Residents of Vermont need not include return postage).

NOTICE TO INDIVIDUALS; REMOVAL FROM MAILING LIST
Any individual (or duly authorized person) may elect to exclude the name and address of that individual from all lists used by Sponsor. To elect to have an individual's name excluded from all such lists, submit a removal request in writing to Deckers Outdoor Corporation at mailing address.
